Amendment Feature

Description

If you have found a mistake after filing the notice of family claim, it can be corrected with our amendment feature. An amendment is a court procedure that corrects the notice of family claim by filing it again.

Overview

This feature enables the amendment settings and generates an amended notice of family claim containing your corrections. But to make it official, the amendment must be filed in court, which is included. So, once the changes have been made, print and send us the document for filing in court.

White Glove Setup

This feature requires some configuration. However, with the white glove setup option, we’ll configure it for you. This option includes standard changes. For custom changes, please contact us for a quote.

Typical uses of an amendment are to correct:

• your answer regarding a party’s legal name or
• your answer regarding a party’s name on the marriage certificate or
• a party’s surname if it would conflict with one of the above.

You do not need an amendment to correct the following:

• the date of separation,
• the date of marriage,
• the place of marriage,
• the birth date of a party,
• the birth date of a child,
• the name of a child, or
• the status of a child.

Considerations for sole divorce:

The amended notice of family claim must be served on your spouse. If you have already served the divorce papers on your spouse, they will need to be served again.

How it works:

1. First, add it to the cart and checkout,
2. Second, navigate to the questionnaire dashboard and click on the Amendment Feature,
3. Next, fill in the details to explain the correction (not required if we are configuring it for you),
4. Then, generate your amended notice of family claim and follow the signing instructions,
5. Finally, please mail it to us to file in court for you.
