The British Columbia Divorce Process

In British Columbia, either one or both spouses can apply for divorce on the basis of separation of at least one year. Since fault is not an issue, the decision on the type of application should be made on the basis of the cooperation of all applicants.

In addition to our plan fee, there is also a court filing fee (a fee charged by the court) that must be paid to the court when each stage described below is filed. The court filing fee is $210 for stage 1 and $80 for stage 2. If the optional divorce certificate is desired, the court filing fee is $40 for each one. The court fee is not included in our plans and can be paid by credit card on our store or by money order when you submit your forms to us for filing.

Joint Divorce

A joint divorce is an application for divorce by both spouses.

  1. Complete our questionnaire
  2. Purchase a plan
  3. Both spouses sign and send us the stage 1 forms and marriage certificate
  4. We review and file stage 1 in court and obtain the court file number
  5. Both spouses sign and swear the stage 2 forms and send them to us
  6. We review and file stage 2 in court
  7. The court processes the documents, which may take up to 4 weeks
  8. We check back with the court regularly, and when the response is received, we send it to you

Sole Divorce

A sole divorce is an application for divorce by one spouse

  1. Complete our questionnaire
  2. Purchase a plan
  3. The applicant signs and send us the stage 1 forms and marriage certificate
  4. We file them in court and return a filed copy of the stage 1 forms
  5. The applicant arranges for the stage 1 forms to be served upon the other spouse
  6. The applicant signs and swears the stage 2 forms and sends them to us
  7. We review and file stage 2 in court
  8. The court processes the documents, which may take up to 4 weeks
  9. We check back with the court regularly, and when the response is received, we send it to you
